3. SERVICE DESCRIPTION

We provide an online platform for reputation management, allowing our clients (businesses) to request and manage customer reviews using email, SMS, and automation tools. Each client may receive a subaccount to manage their campaigns.

We do not guarantee specific outcomes such as number or quality of reviews. Results may vary.

4. ACCOUNT REGISTRATION

You agree to:

Provide accurate and complete information
Maintain confidentiality of your login credentials
Notify us of any unauthorized use of your account

We may suspend or terminate your account if you violate these Terms.

5. PAYMENTS AND BILLING

We use third-party processors like Stripe and PayPal. You agree to:

Provide valid payment details
Pay applicable fees, including taxes
Accept recurring billing if on subscription

If payment fails or is not completed, we may suspend or terminate access.

6. SUBSCRIPTION AND TRIALS

We offer a 14-day free trial. After the trial, subscriptions renew monthly at $147 USD unless canceled. You may cancel anytime before the billing date to avoid charges.

7. THIRD-PARTY INTEGRATIONS

Our Services may integrate with platforms such as:

Stripe, Meta/Facebook, Google Ads, Gmail API, WhatsApp API, Zapier, OpenAI, Twilio (A2P 10DLC), etc.

By connecting your accounts, you authorize us to interact with those platforms on your behalf. We are not liable for any issues arising from third-party service interruptions or changes.

8. COMMUNICATIONS AND CONSENT (TCPA/CAN-SPAM COMPLIANCE)

By using our Services, you agree to:

Only send communications to recipients who have given proper consent
Honor opt-out requests (e.g., STOP for SMS)
Follow applicable laws including TCPA, CAN-SPAM, A2P 10DLC regulations

You are solely responsible for the content of your messages. We are a technology provider only and do not verify recipient lists.

9. USE OF AI-GENERATED CONTENT

Some features may use AI (e.g., OpenAI) to generate messages or responses. AI content:

Is for assistance only
May contain errors, biases, or inaccuracies
Should be reviewed before being sent

You are responsible for reviewing and approving any AI-generated content before using it in your campaigns.

10. PROHIBITED USES

You agree not to:

Violate any laws or regulations
Use the platform for spam, fraud, or abusive content
Interfere with security features
Attempt to reverse engineer our software
Upload malicious code or automated scripts without permission.

11. INTELLECTUAL PROPERTY

All content and software are owned or licensed by LINKU MKT LLC. You may not reproduce, modify, distribute, or exploit any part of the Services unless explicitly authorized.

12. RESULTS DISCLAIMER

LINKU MKT LLC does not guarantee:

Any specific number of reviews
Positive outcomes
Improved reputation or business performance

Examples of success or testimonials are illustrative only.

13. SERVICE LIMITATIONS

We are not liable for:

Downtime or outages of third-party platforms (Twilio, Meta, Google, Stripe, etc.)
Delays or undelivered SMS/emails
Lost or altered data

14. DATA SECURITY

We implement reasonable measures to secure data, including:

HTTPS encryption
Third-party secured payments
Authentication protections

We are not liable for breaches outside of our control. If legally required, we will notify affected users.

15. TERMINATION

We may suspend or terminate your account without notice for violation of these Terms. You may cancel your subscription at any time. Refunds are not provided unless required by law.

16. DISPUTE RESOLUTION

Disputes shall be resolved through binding arbitration in Kissimmee, Florida, under the FIAC rules. No class actions permitted. You waive the right to join claims with others.
